In the mean time three men (Malone Wright and Camrade) had met, and with Revolvers in hand awaited an opportunity to shoot the soldiers, swearing that they would kill them &c. Malone went up the stairs into the Billiard Salon, and asked for another Revolver stating that "his had but one lead and he wanted more" (that there were two of them").. in the mean time Sergt. Weeks, had entered the Bar Room and was warned by Aicardi the proprieter, that the party would kill him. where upon  the Sergt made his escape through the back door. Aicardi sending the Roughs out of the front door where they saw Robinson on his way to the Quarters. Malone came down stairs at this time. The party immediately assaulted Robinson and used him very roughly. he managed to escape from them and started to run. when Malone fired at him, the shot taking effect just above the hip, entering the back, about three inches from the backbone on the left side, passing across ridges, in and on the right side of the back bone where it still remains. The Surgeon not thinking it safe to attempt its removal.
