I have this day transmitted to his Excellency Gov Patton a petition asking pardon of one Dave Brooks a colored man - the petition sets forth the evidence in the case - and at the same time shows that said Brooks and a white man by the name of E Peck was indicted for mule stealing - that on the trial Brooks was found guilty and Peck acquited - Petitioners also state that they heard the trial and that in their opinion if one was guilty the other was equally so - and that as Peck was acquited Brooks should be pardoned
