upon a review of the testimony submitted The Board are under the opinion that the Stores in question were all shipped at Demopolis Ala. upon ch. Steamboat Jennie Roger

That the specification in the Bill of Lading given by that Steamboat. To wit. "being in good order and well conditioned" is a complete and entire assent upon the part of the Steamer to the correct condition of the stores and their correspondence with the terms of the invoice and the absence herefrom of specified weight does not impair its validity because the manner of transportation upon water by Steamboats is as recognized by law and certain to be by measurement only weight. at the option of the Carrier.
That this Steamboat failed to deliver his share in good order at Tuscaloosa and was short of "Issuing" the amount stated trust of Bacon 496 pds of Corn 2339 pds and the Board therefore found the responsibility of this loss upon the Steamboat "Jennie Roger" and relieves Bvt Blair Sub Asst Comm'r from any further responsibility therefor.
There being no further business before the Board it adjourned.
