was made against said Cunningham, by Freedman Carter Piles, who reported having met Cunningham on the road while on his return from the Polls, Cunningham halted him and asked where he had been, when the Freedman who was in company with others stated that he had been voting, when he commenced abusing the Freedman and said that he could "lick any damned son of a bitch" white or black who voted for the Constitution, Cunningham was accompanied by his Brother and both of them attempted to ride the Freedman down, but not succeeding he John Cunningham dismounted attacked the Freedman Piles and by kicking and striking injured his person in several places, saying at the same time, "May God Damn you go by the Yankees" and report me, upon hearing these statements and being corroborated by witnesses, I wrote him a letter requesting him to report at my Station for an investigation, I informed him in my letter if he did not report in due time that I would send a guard for him, and from a few days after the Election closed until last Thursday was then informed that he had said he would not come, when I sent a guard after him, and was brought to this Station on the 20th inst, when I confined him in jail, On the same day that Cunningham was brought in I learned that he had turned off a Freedman named Lark Elston (over)
