On this 1st day of October AD 1867 personally appeared before me J.F. Allision a 1st Lient[[?]] United Sates Vols. H.F. Childers, J.E. Childers, and Thomas Billings, who being duly sworn depose and say that on or about the 26" day of June A.D. 1867 a case was presented for trial before James Reynolds in which the State was Plaintiff and Willis Childers and other defendants. The Witnesses for the State were Samuel Carmichael, and John A Hurel both respectable men of Color whose testimony was excluded by said James Reynolds a justice of the Peace on the ground that they were men of color and not allowed to testify against white men unless they were concerned. The consequence of which the case was dismissed for want of evidence.
