It appears that the property is not under control of the Bureau as long as Capt Gear requires it for Military purposes

States by direction of the COO Candy that the operatives of the F Bureau in this District are in entire accordance with the acts of Congress & order from the different Bureaux of the War Dept. and that its officers have generally performed their duties Creditably. Respectfully forwarded for information of the Asst Comr of NC. This letter is in response to an indorsement forwarding a copy of Cir 22 inquiry whether the remarks of Lt Gen Grant applied to the affiars in this District. In explanation of the impression Gen Grant received that Officers of the Bureau considered themselves independent of the military establishment. I would suggest that Gen. Order No 49 2.M. Office and the decisions under it, that officers of the Bureau must first look to the plantations under their charge for their allowance of fuel and forage have done more than anything else to create the notion in their minds. The army Regulations which have the force of an Act of Congress provide that all officers shall receive these allowances. No General or Special Order from any source, nothing short of a sentence of a Court Martial can suspend these emoluments which are a part of the pay stipulated to any officer who holds a commission. There appears to be no reason why assignment to the Br R.F.&A.L. should cut off these allowances unless it is intended that the Bureau should be "independent of the military establishment". The pay proper of an Officer might as well be cut off by the pay Dept. as his regulation allowances. no small part of his pay by any other department Respectfully by Secty Supt
