different subject. Yesterday P.M. Jan 31st I was arrested & placed in the jail without any charges preferred against me or any information of the reason of it, except that it was as ordered.

This morning I was examined by Mr. Fitz on charge of stealing nails from his building. Of the witnesses examined, neither of them did or could swear to anything of that kind against me.  They were to the nails being taken [[strikethrough]] & [[/strikethrough]] but could not, & would not swear it against me.  I was not allowed to bring any witnesses to my character, or for my defence. I was fined $20. or go to prison.  Mr. Fitz made the statement that Mr. Pond told him that I had stolen nails & stock from him.  And this was the burden of evidence against me. 

On the contrary I can bring Mr. B.W. Pond, & Mr. Joseph Wade of New Berne, & others to make statement of my honesty & fidelity.  And my request now is that I may have opportunity to recover my money which
