does the Laws of north Carolina compel a man who has no Property to work out a roads Tax

"It should be the duty of the overseer of public roads 3 days before day of working to summon all white males between 18 & 45 (colored between 16 & 50) within the district to work on the roads. If they fail to appear they forfeit one dollar per day. There is no law that I know of to force any one to work on the road and I know of no penalty that the forfeiture of the dollar a day which it would be difficult to collect of a man who has no property- Seymour
