(State of North Carolina) (Carteret County) Memorandum of an agreement entered into the 9th day of January 1867 by and between, David B. Wharton of the county of Carteret and State of North Carolina and Sam Burney of the County and State aforesaid. The said David B. Wharton agrees to let the said Sam Burney work his farm situated on New Berne Road about Six(6) Miles from Beaufort. The balance of this year (1867). The Said Sam Burney agrees to replace the fences clean out the ditches and clear the farm. Also, to cultivate the farm and do all the work as directed by the Said David B Wharton. He further agrees to pick the cotton and deliver the same to R.W. Bells Gin on New Bern Road. Also to gather any other produce that may be raised on said farm and store the same in the house. The Said David B Wharton agrees to furnish seed tools and team to cultivate said farm. He further agrees to pay to Sam Burney one half of the crop raised on the said farm. It is further agreed by and between the parties aforesaid that if the said Sam Burney fails to cultivate the said farm as directed by said D.B. Wharton: the said D.B. Wharton is to have the work done that is necessary and deduct the expenses of the same from the said Sam Burneys part. As witness our hand and seals, the day and year first above written David B.
