Constitution and By-Laws............................5

(a) Continued failure to be cooperative.
(b) Deliberate action against the interests of the Arts Council.
(c) Individual activity contrary to the Arts Council Preamble and Purposes.

Section 2. The following procedure will apply in case of expulsion:
(a) The member in question shall be notified to appear before the Executive Board and Officers to answer charges. Non-residents of New York City will be served with a written notice of charges which they must answer in writing.
(b) The Executive Board and Officers shall then, after due consideration of all the evidence, decide what action, if any, is to be taken.  The Executive Board shall report all such decisions to the membership of the Arts Council at the first subsequent general meeting.
(c) A petition signed by ten Active Members and filed with the Executive Board may re-open any individual case for re-hearing.

X. IMPEACHMENT
Section 1. Any officer may be impeached by the general membership by the following procedure:
(a) An impeachment petition stating all charges against the Officer and signed by ten Active Members must be filed with the Executive Board.
(b) The Officer in question shall be notified to appear before the Executive Board to answer these charges. At least three signers of the petition must also be present.
(c) The Executive Board and officers shall then, after de consideration of all the evidence, recommend specific action. The Executive Board shall report its recommendation to the membership at the first subsequent general meeting.
(d) The general membership shall then, by majority opinion, accept or reject the Executive Board's recommendation. In the event of rejection, the case of the Officer in question shall be decided by the general membership at the same meeting.

XI. AMENDING THE CONSTITUTION
Section 1. Any amendment to the Constitution or By-Laws of the Arts Council of Japanese Americans for Democracy becomes effective when it is passed by the Executive Board and Officers, adopted by a two-thirds vote of the total membership, and signed by the Chairman of the Arts Council.
