case is but a sample of the decisions of the Mayor of this City. Notwithstanding his statement "That all cases which come before me all judged fairly and impartially, often bearing all testimony" I am well convinced that in this case as in all others where colored men are concerned, the fact of their being colored men, is so strong against them that it requires a great amount of evidence to overcome the presumption of their guilt.

Respectfully referred to Bvt. Brig. Gen'l. E. Whittlesey, Asst. Comr. for N.C. In my opinion the case of the northern murdered men should properly come before a Military Commission. This offence with which they are charged having been committed during the war, amid while some of the accused were in the Military Service of the United States. I fully concur in the opinion expressed by Lt. McQuigg, that a fair trial cannot be had.
