If the Plaintiff Smith proved that the colt in question was the same that was stolen from him, he is entitled to it and the Defendent Bryant has no claim in law for the difference in the value of the colt at the time he was stolen and now altho he may have bought the colt in good faith still he only purchased the interest of the party who sold to him - and no matter how many hands the stolen property may have passed through its proper owner could reclaim it Mr. Bryant has a good claim against the party who sold him the colt in that implied warrantie of title

Respectfully returned to Capt Justin Hodge Asst Supt. who will cause the mule to be delivered to Ellen Hicks- On the within statement it does not appear that the man Dallas Emmons had any authority to take the mule from the Plaintiff Ellen Hicks and use the same to pay his debts-
