be arrested and tried by a Military Court, stating that as the parties were prominent citizens of the County there was no possibility of their being punished by any Civil Court; and stating that some of the most outrages cases of assault by White men on Freedman had been punished at the last term of this Court by a fine of Ten Dollars; as an example of what punishment would be inflicted if they should be found guilty
I endorsed Mr Birnie's Statement, and sent it to Bvt Lieu't Col R.J. Frank. Comdg Post. with a request that the parties be arrested and brought to this City, with a view to their trial by a Military Court.
Col Frank, in compliance with my request, caused the arrest of the men, they were brought to this City, and are now I understand at liberty on parole; all the papers have been forwarded to General Sickles.
