the statement which Alfred Smith made to you as to Barney Boweler ability or solvency is also not the truth, the money could never be collected according to Law out of him he has very little indeed not one fourth what the Law allows every body. I knew it would be making them pay cost at some future time uselessly, and done all that I could to get them both to work out the debt. They both have repeatedly promised to work for me, but as yet they have not done it, and I fear never will.

The contract between Alfred Smith (Freed) and myself, was drawn by Lieut Eckelberry and Alfred Smith says is on file in your office which I most respectfully ask you to examine and see what [[strikethrough]] were [[/strikethrough]] are the terms of it. We do not differ as to the terms, but he insists that I should pay him the corn agreed upon, and let him owe me for everything that I furnished him during the year 1867, to which I object, and have Respectfully refered the matter to you to decide according to the contract between us, also according to justice & law.

You will see by referance to the contract that he was to receive for his services for eleven months of the year 1867 38 Bushels of corn at one dollar per Bushel, 5 Bushels Potatoes at fifty cents and two hundred pounds of Pork, I was also to
