DRAFT OF BILL TO ESTABLISH A RETIREMENT SYSTEM FOR AIRLINE PILOTS

AN ACT

To establish a retirement system for air line pilots and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled.

TITLE I

DEFINITIONS

SECTION 1. That for the purposes of the Act --

(a) The term "employer" shall mean any common carrier by air engaged in interstate or foreign commerce, and any carrier by air transporting mail for or under contract with the United States Government.

(b) The term "pilot" shall mean any individual who shall be, after the enactment hereof, in the service of one or more employers for compensation. Any individual who, during the thirty-six months ending at the end of the month in which this Act was enacted, was in the service of one or more employers in all or part of at least eight calendar months shall be deemed to have been a pilot after this Act was enacted.

(c) An individual is in the service of an employer if

(i) he is subject to the continuing authority of the employer to supervise and direct the manner of rendition of his service, and

(ii) His duties include (A) the command of aircraft while under way, or (B) responsibility for the manipulation of or the manipulation of flight controls of aircraft while under way, including take-off and landing of such
