Civil Air Regulations Amendement 21-5

CITIZENSHIP REQUIREMENTS

The present provisions of the Civil Air Regulations concerning citizenship requirements, promulgated as wartime regulations, lack uniformity of working and do not prescribe standardized requirements. Certain sections provided for the granting of airman privileges to citizens of foreign governments which grant reciprocal privileges to citizens of the United States, while other sections do not provide reciprocal privileges. Information has been exchanged with a number of foreign governments relating to the granting of reciprocity in the issuance of airman certificates with commercial privileges. As a result of these conversations it is deemed desirable to prescribe standardized citizenship requirements permitting the issuance of an airman certificate to a national of any country which grants or has undertaken to grant reciprocal privileges to citizens of the United States. 

Interested persons have been afforded an opportunity to participate in the making of this amendment, and due consideration has been given to all relevant matter presented.

In consideration of the foregoing the Civil Aeronautics Board hereby amends Part 21 of the Civil Air Regulations (14 CFR, Part 21, as amended) effective August 26, 1948:

By amending ยง 21.12 to read as follows:

21.12 Citizenship. Applicant shall be a citizen of the United States or of a foreign government which grants or has undertaken to grant reciprocal airlines transport pilot privileges to citizens of the United States on equal terms and conditions with citizens of such foreign government.
