Gentlemen:

I am placing in our Reference File the Board's Opinion in these two safety cases for future use in defending License Revocation Cases. Following is a very brief summary of the Opinion.

The Respondents took off simultaneously with DC-3's on intersecting runways. One of them was forced to make a left turn immediately upon leaving the ground in order to avoid a collision. They were charged with careless and reckless operation and the Hearing Examiner found each guilty and recommended a seven-day suspension of their Airmen's Certificates. Both filed Exceptions with the Board. The Board upheld the Examiner in his Finding that both airmen were guilty of careless and reckless operation but found further that in view of the fact that both are "mature and experienced pilots" and demonstrated "cooperative attitudes" the Public Interest did not require the suspension of their Airmen's Certificates.
