Dear Mr. Rach:

The other evening I received a phone call from Captain Memmers and we discussed the proposed Letter of Agreement which was drawn up several weeks ago to cover the situation where pilots were being displaced on the Bermuda operation. You sent Headquarters a copy of the draft prepared by Rad Janas relating to this matter and, frankly, after looking it over, Headquarters feels the approach we have taken is better than the one submitted by the Company.

In the first place Janas says the pilot "may at his own expense subject to Section 9, Paragraph (d)" go through the various steps outlined in the Letter of Agreement. It think we should play down the idea of the pilot doing this at his own expense and let the Company pay the cost.

Further, Mr. Janas says the "entire Letter of Agreement is supplemental to Section 17 of the Agreement effective August 1, 1949." You will note in our proposal we say "This entire Letter of Agreement is subject to Section 17 of the Agreement effective August 7, 1949."

Actually your entire bidding Section or any section or paragraph relating thereto is subject to Section 17, Seniority General. And it is very important that we do not, by inference, at any time submerge Section 17 in any manner.

I am sending herewith six (6) copies of the Letter of Agreement. You will note that we have not even recognized the change in language as proposed by the Company in Paragraphs (d) and (e) for a very good reason. The Company proposes to change the words "fly as" in Paragraph (d) to "become." This change is not proper because you do not become a reserve pilot, but instead you fly as a reserve pilot. The same thing applies to Paragraph (e).
