Re: Gitt vs Colonial

Dear Mr. Cooper:

This will acknowledge yours of December 1st, in which you state that you have been informally advised that the System Board desires to process the Reserve Pilots' Pay Grievance to the System Board prior to the Hearing of the Gitt Case by a neutral-fifth member. I have not been informed to that effect. However, it would seem to me that we should proceed as quickly as possible to designation of a neutral inasmuch as in all probability considerable time will lapse between his appointment and the Hearing of the case.

On November 23rd, I submitted the name of David L. Cole. To date, the Company has not indicated its acceptance of Mr. Cole nor has it proposed the names of any other neutrals. In the event Mr. Cole is not acceptable to the Company, I submit the name of Robert Simmons, Chief Justice, Supreme Court of Nebraska. Judge Simmons has acted in this capacity on matters involving the Association and Pan American Airways and I am confident that Messrs. Everett Goulard or Jerome D. Fenton of Pan American will give you any information you desire regarding Judge Simmons ability and impartiality.
