Re: Michael A. Gitt vs Colonial Airlines

Dear Mr. Cooper:
In the Agreement between Colonial Airlines, Inc., and the air line pilots in the service of Colonial Airlines, Inc., as represented by the Air Line Pilots Association, International, covering the establishment and maintenance of a System Board of Adjustment, signed on the 10th day of August, 1940, there appears the following paragraph:

"The Board shall consider any dispute properly submitted to it by the President of the Association or by the Chief Operating Officer of the Company when such dispute has not been previously settled in accordance with the terms provided for in the Pilots' Agreement."

Following is the submission of the grievance of Michael A. Gitt to the Colonial Airlines' Pilots' System Board of Adjustment:

1. question at Issue

Did the Company violate Sections 17 (c), 27 (a) or any other Section of the Pilots Agreement in filling the vacancy on the Bermuda operation bulletined on or about May 19, 1949?

2. Statement of Facts

On or about May 19, 1949, the Company bulletined a Temporary Bermuda Captain's Vacancy. The deadline for bidding was designated as May 30th. (See submission Exhibit No. I) On May 27, 1949, the deadline for filling bids on this vacancy was extended to June 6, 1949. (See submission Exhibit No. II) Captain M. A. Gitt, the grievant herein, filed his bid on May 29, 1949, which was prior to the original deadline date. Capt. N. J. Uttenweiler filed a bid on June 3, 1949 and
