Dear Dave:

The following are some notes of our telephone conversation of yesterday. 

1. We agreed to await for a possible answer from Mr. Elwell to your letter of April 6, 1950, before I would actually send a check in offer of settlement for the fine. We felt that your letter required an answer if only a letter of acknowledgement. Therefore, we should let a reasonable amount of time elapse before pursuing the next step in this case. 

2. I would contact Larry Cates the first thing Monday morning acquaint him with the facts, and request him to keep an eye on the situation and not let the case "jell" or come to a head prematurely. Also, to caution Larry Cates about "barging" in and perhaps disrupting the normal progress of Mr. Elwell's action in this case.

3. I asked you if you would be in favor of trying to get the Company to participate in the costs if we decide to fight this case in the courts. As I recall it, you thought it was a good idea and we should by all means try to get their cooperation.

4. You said that you would send copies of your letter of April 6, 1950 to Mr.Elwell and myself, to Larry Cates so that he would be up to date on the latest developments. 

I am sending you a copy of these notes because as I recall it a lot of thoughts were exchanged and I did not want to lose sight of any of them.

I am also sending Larry Cates a copy of this memo for his information.
