Re: Grievance of Capt. Michael A. Gitt

Dear Mr. Dykes:

I have received a copy of the record of the Appeal Hearing of the subject grievance held August 2, 1949.

Your attention is invited to the statement made on the last page of the record, preceding the copies of the correspondence, as follows:

Dykes: Assuming that the grievance was timely the issue in this case is did the Company violate Section 27 A of the Contract or not.

Schy and Cooper both agreed this was the issue.

So that there can be no confusion on the position taken by the undersigned from this statement in the record, I would like to reiterate that the company agrees that one of the primary issues in the case is whether it violated Section 27 A of the contract. Other issues, however, are the timelines of the filing of the grievance and the fact that Capt. Murray has stated that he would have bid the Bermuda run prior to the original closing date, were it not for the fact that the closing date was extended. The undersigned believes that the interests of Capt. Murray also require consideration of Section 17 of the agreement. 

These items were fully discussed at the hearing and the position is reiterated at this time merely to avoid any misinterpretation of the record.
