Dear Captain Gitt:

Referring to the Appeal Hearing held in this office on August 2, 1949, re your grievance filed June 11, 1949 protesting the award of the temporary run on the Bermuda Operation to Captain A. K. Murray, it appears to the writer:

1. That you claim that certain provisions of the working agreement between Colonial Airlines, Inc. and the Air Line Pilots Association were violated by reason of the Company's failure to award the temporary run on the Bermuda operation to you, pursuant to the bulletin posted on May 19, 1949.

2. That you claim because of the extension of the closing date of the bulletin by the Company on May 27, 1949, from 0900 E.S.T. May 30, 1949 to 1000 E.S.T. June 6, 1949, Captain A.K. Murray was permitted to file his bid on June 4, 1949, and as he was the senior pilot bidding was awarded the run on June 6, 1949.

3. That you claim the Company urged Captain Murray to file his bid, and that he would not have bid on the vacancy if the closing date of the bulletin had not been extended from May 30, 1949 to June 6, 1949.

4. That you claim the above action of the Company violated Section 27, Paragraph a of the working agreement, which may have caused you to suffer.

5. That the Company posted on May 19, 1949, the bulletin requesting bids on the Temporary Bermuda Captain Vacancy, with a closing date of May 30, 1949. On May 27, 1949 the Company posted a bulletin extending the closing date of the bulletin to June 6, 1949.

6. That you filed your bid for the vacancy on May 27, 1949, Captain N.J. Uttenweiler filed a bid for the vacancy on June 3, 1949 and Captain A.K. Murray filed his bid for the vacancy on June 4, 1949.
