Re: Gitt vs Colonial

Dear Mr. Dykes:

No doubt by the time you receive this you will have already rendered your Decision in the above-entitled case. However, I wish merely to state in reply to Mr. Cooper's letter to you of August 4th, that in my opinion the Issue before you for determination was and is, "Did the Company violate the Pilots' Agreement in the manner of its awarding the vacancy bulletined on or about May 19, 1949?"

In my opinion, the question of timeliness and the question of what any other Colonial pilot did or intended to do is not a part of the Issue. These items might be factors in influencing a Decision on the Issue but are not part of the Issue itself.
