Dear Mr. Schy:

Enclosed please find the use that the Company has made of Judge Simmons decision. You will please note the stipulation of "qualifications" as a prerequisite to a successful bid on the Bermuda operation.

For you information, it so happens that the most senior pilot eligible to bid in this vacancy was called upon to help out (special assignment) the latter part of last month, although he has not as yet been able to successfully fulfill the requirements as set forth in the enclosed bulletin.

In the advertised bulletin, mention is made of previous notices to the effect that minimum requirements for assignment to the Bermuda operation, etc., these previous notices very obviously waive the training section of our contract, inasmuch as they required the pilots to take the training and maintain their proficiency in the required subjects on their time off.

The classes are to run continuously and the pilots may attend these classes on a catch as catch can basis, without knowing in any way whatsoever if they can make up what ever they missed.

I have just attempted to point up just a few of the "high spots" in this bid. You will no doubt see other contract violations and, of course, you will no doubt notice where the council has interfered with managerial prerogative in the first part of the notice.

The second enclosure is also a masterpiece in that it is a request for a bid that may or may not exist. I wonder what will happen if a single reserve man bids in both vacancies.
