Dear Mr. Gitt:

This will acknowledge receipt of your letter of April 26, 1950, with which you forwarded a check in the amount of $150 as an offer in compromise of civil penalties for which you may be liable by reason of an alleged violation of the Civil Air Regulations, in connection with your operation of a Colonial Airlines' scheduled flight between LaGuardia Field, New York, and Albany, New York, May 6, 1949.

As you have been advised in previous correspondence, no facts have been presented by you which warrant any reduction in the amount of $300 which was originally suggested to you as one which, if offered in compromise, we would recommend to the Administrator for acceptance. Accordingly, your offer of $150 will not be recommended for acceptance. In the event you do not submit and offer in compromise totaling $300, within five days after your receipt of this letter, the $150 already submitted by you will be refunded. In that event, appropriate steps will be taken for the filing of a civil suit in United States District Court to recover the civil penalty.
