THIRTEENTH BILENNIAL CONVENTION

SUBJECT
Association merger procedures. 

STATEMENT OF QUESTION*
Shall the Association's present procedure for the handling of seniority disputes be revised.

Submitted by the Executive Committee in a letter dated September 15, 1954. 

RESOLUTION OF THE BOARD OF DIRECTORS
WHEREAS this Seniority Committee has extensively reviewed the past and present policies and procedures for the handling of seniority merger disputes, in accordance with their letter of assignment, and

WHEREAS the specific assignments outlined in paragraphs one and two above are summarized in the Report of the Committee, and

WHEREAS it is further the assignment of the Seniority Committee to make recommendations to the Board of Directors for the improvement of the procedures or policies of the Association for the handling of problems arising from mergers,

THEREFORE BE IT RESOLVED that because application of past Association policy and procedure, governing integration of seniority lists resulting  from a merger or consolidation of air lines or parts thereof, has proven controversial and indecisive and has resulted in costly litigation with accompanying pilot animosity to the detriment of the pilots and the Association, such policy and procedure from this date forward be superseded and made inapplicable to all future mergers or consolidations, and

BE IT FURTHER RESOLVED that the Committee recommends the adoption of the following as Association policy and procedure:

When in the opinion of the President of the Association a merger or consolidation of air lines or parts thereof is pending, it will be his responsibility to notify the M.E.C. of each affected air line that, in accordance with this procedure, it is their responsibility, as representatives of the affected pilots, to meet and activate the following Association procedure for the settling of their possible seniority merger problems:

The Master Executive Council of each of the affected air lines will, prior to the original date of Government approval, appoint a committee to investigate and compute the cumulative length of service, as a pilot, of each pilot named on their current seniority list, utilizing all available pilot and company records. 

The terms of the current working agreement for each air line will be applicable and will govern the computation of length of service credit for each pilot.
