Dear Captain Muirheid:

Thank you for your letter of February 28 referring to the Special Committee on Age 60 and their retaining Mr. Madole.

One of the reasons which prompted my letter was the last part of the resolution that said the Committee would coordinate their activities with the President to maintain financial control. Mr. Ruby had asked me if I had heard anything about the matter. I will send Mr. Madole a copy of the form drafted by the Executive Committee for outside counsel.

Incidentally, Gerry Goss also replied to my letter and asked me to keep the Committee informed of any correspondence realting to the age 60 question. I do receive letters from pilots approaching age 60 and I will copy them and send them to the Committee.

The copy of your notes of the Committee's February 7 meeting is appreciated - especially the Committee's inquiry into the application of Public Law 90-202. A study of that law was made in this Department, including the legislative history. I have also acquired a booklet entitled "Age Discrimination in Employment Act of 1967" - it discusses, among other things, the fact that the Act specifically excludes the United States or any agency thereof. I have only a limited supply of these booklets and have sent one to Chairman Goss. If any of the members of the Committee are interested, I am sure we can obtain more of these booklets.

One sentence in your notes of the February 7 meeting interests me. There was a statement that the Executive Committee had been furnished incorrect information by ALPA's legal Department on the current status of the Furlow case. I would appreciate it if you would enlighten me on this. I have no personal recollection of it and neither does any of the staff. I have made a thorough search of the office and find that we have no file at all on the Furlow case and apparently this Department was never involved in it. I do find a letter dated August 18, which is reproduced and attached here, indicating
