Gramza, Director Legal Department Air Line Pilots Association 55th Street and Cicero Avenue Chicago, Illinois 60638 Dear Mr. Gramza: This will acknowledge receipt of your letter dated February 26, 1968 in reply to my letter to you of February 23, 1968. Thank you for your prompt reply. In the fifth paragraph of your February 26th letter you requested me to enlighten you on the matter of information furnished in the Executive Committee regarding the status of the Furlow Age 60 case. At the October meeting of the Executive Committee there was an agenda item on the status of the Furlow case. This item was deferred until the next regular meeting of the Executive Committee. The agenda sheet furnished to the Executive Committee. The agenda sheet furnished to the Executive Committee (January 16-18, 1968 meeting) contained the following background information. "In a recent report on the desirability legally of attacking the age 60 regulation of the FAA, there is some implied reference to the Furlow case. The adverse FAA decision on Furlow's effort to have a waiver established on the age 60 rule was appealed to the NTSB where the FAA decision was upheld. At that time, a decision was made not to appeal the NTSB decision to the Circuit Court since no new evidence was available to present, developing the likelihood of another adverse opinion." This information was entirely incorrect. It was my natural assumption that the above information was supplied by ALPA's Legal Department.
