Dear Captain Gitt:

I have been away from the office for two weeks and apologize for this late reply to your letter in which you applied for a position as a pilot.

Needless to say, we have discussed this general problem, particularly as it applied to the age 60 cutoff requirement of the FAR. There are several reasons why we cannot employ you as a pilot.

1. It is current company policy that our managers of flying, instructor pilots, and engineering/test pilots be taken from the seniority list and that these pilots periodically fly the line. The line flying requirement enables such pilots to retain familiarity with the rapidly changing on-line procedures and conditions, which in turn enables them to do a better job in the training and check pilot areas.

2. The Basic Agreement between Eastern and ALPA requires that pilots used as supervisors, instructors, or as engineering/test pilots be taken from the Eastern Seniority List.

3. Since FAR does not permit a pilot to fly the line after age 60, application of the prior stated company policy and Basic Agreement requirement precludes the use of over age 60 individuals for flying assignments.
