The Rules of Annex 13

Let's start with the definition, "aircraft accident".—— It is an occurrence associated with the operation of an aircraft which takes place between the time any person boards the aircraft until such time as all persons have disembarked, in which any person suffers death or serious injury, or the aircraft receives substantial damage.

There are rules about protection of evidence and custody of the wrecked aircraft. The nation in which an aircraft accident occurs must take all reasonable measures to ensure the protection of evidence "including the safe custody of the aircraft and its contents for such a period as may be necessary for the purposes of an accident inquiry." Such safe custody must include reasonable protection against further damage, access by unauthorized persons, pilfering and deterioration, and requires the preservation by photographic records of any material evidence which might be removed, effaced, lost or destroyed. If a request is received from the Nation of Registry that the aircraft, its contents, and any other evidence remain undisturbed pending inspection by an "accredited representative", the nation conducting the investigation must comply. Further, the nation in which the accident occurs must release custody of the aircraft, the contents, or any parts thereof, which are no longer needed for the investigation, to the party designated by the Nation of Registry.

The Annex now requires both an initial and subsequent notification to other nations about aircraft accidents. The nation in which an aircraft accident occurs must notify the Nation of Registry and the nation in which the aircraft was manufactured with the minimum of delay and by the quickest means. Thereafter, the Nation of Registry must
