Dear Mr. Muirheid:

This will acknowledge your letter of February 7, 1962, enclosing a copy of a proposed letter from the Eastern Air Lines Master Executive Council to all Eastern Air Lines' pilots.

The interpretation of section 40.320 contained in this letter are correct and accurately reflect the discussions which took place in my office with you, personnel of this Division, and representatives of the Federal Aviation Agency General Counsel's office. There is, however, a need to clarify Paragraph 3, Page 7, of your proposed letter to the pilots. We have inserted on the original of your proposed letter, which is enclosed, suggested wording of a phrase which should preface the last sentence of this paragraph to more clearly indicate that the provisions for computing ground duty time, in the case of deadheading, are purely a matter of your employment agreement and do not reflect any requirement imposed by this Agency.

I would like to take this opportunity to commend your diligent and cooperative efforts in meeting with us to preclude any misunderstanding among Eastern Air Lines' pilots of the flight time limitations contained in the regulations.
