Dear Mr. Basnight:

At the meeting held on August 9, 1962 in which we discussed the application of the term "series of flights" as used in the flight time limitations prescribed in section 40.320(c), you were advised that we would carefully consider your views together with those of the air carriers in an effort to seek an equitable resolution of the problems involved. At the conclusion of the meeting we also advised you that we would submit for your consideration any flight schedules in addition to those discussed at the meeting which illustrated series of flights which do not conform with our previous interpretation, but which should be considered in the resolution of our problems.

A review of selected sample scheduls indicates that such schedules are basically similar to those discussed at our meeting and illustrated in examples (a) through (f) of the schedules originally submitted to us by Mr. Bell on behalf of Eastern Airlines by letter dated April 17, 1962. As you will recall, these schedules were also discussed at a previous meeting attended by you and Capt. Muirheid. Accordingly, we do not believe that it would serve any useful purpose in the resolution of this problem to submit any additional schedules for consideration of the members of your Association. The enclosed copy of our reply to Mr. Bell adequately explains the position of this Agency in regard to the schedules illustrated in examples (a) through (f) of his letter as well as other schedules which may come within the basic pattern of such examples. As stated in the letter to Mr. Bell, this matter will be resolved by rule making action by the Agency. Therefore we will also be deeply interested in any comments or suggestions which the Air Line Pilots Association may have as to the substance of such proposal.

If you wish to discuss this matter further, we will be pleased to meet with you on other representatives of your Association at any time.
