have to be given 16 hours of rest at IDL since they actually flew over 8 hours in a 24 hour period (Ref. Part 40.320(c) below).

In this example:

QUESTION: Are the pilots illegal because they are not given 16 hours free of all duty in DCA because they have flown over 8 hours in a 24 hour period?

ANSWER: NO .... They may proceed to RDU since they are allowed to complete their flight or series of flights, scheduled to be completed within the 24 hour period, before starting their 16 hour rest period. The 24 hour period in this example runs from 1900 at BOS to 1900 at RDU.

In the above example, assume that the pilots arrive at RDU at 2000 due to delayed departure from DCA.
