and ALPA, the FAA required rest periods must be inclusive within the hours remaining after subtracting 1 hour and 15 minutes from the block-in to block-out time. Note that this is done in the examples shown above. Section 17-B also provides that when pilots deadhead in and fly out, one (1) hour must be subtracted, and when pilots fly in and deadhead out, only 15 minutes must be subtracted to determine if sufficient hours remain for required rest.

40.320 (g)
"A flight crew member shall not be considered to be scheduled for duty in excess of prescribed limitations, if the flights to which he is assigned are scheduled and normally terminate within such limitations, but due to exigencies beyond the air carrier's control, such as adverse weather conditions, are not at the time of departure expected to reach their destination within the scheduled time."

Comment:
The applications of 40.320 (g) above are only to the hourly limitations contained in 40.320 (a) and to 40.320 (b) in cases where pilots are not scheduled for more than 8 hours in any 24 consecutive hours. For an example of this refer to the comment on Part 40.320 (a) at the top of page-2- of this letter. In cases where pilots are scheduled over eight (8) hours in a twenty-four (24) hour period the intervening rest period required under Part 40.320 (b) must be twice the number of actual hours flown since the last preceding rest period and 40.320 (g) above does not apply.
The intent of the Employment Agreement between Eastern Air Lines and ALPA is that Eastern pilots will operate under the flight time limitations of CAR Part 40 (See Section 17-G). Since we have no International Operations Division, we have an agreement with Eastern that none of our flight operations will be conducted under the flight time limitations of CAR Part 41.
