Dear Captain McDougal:

With respect to your letter of December 8, 1967, regarding the age sixty problem, it is most gratifying to see such action taken by your Council to pursue this abusive ruling of the FAA.  I am most pleased to welcome Captain Gitt and Captain Richardson to the team which is being assembled.

As published in the October 5-7, Executive Committee Report, the resolution which follows was adopted:
  
"WHEREAS the Executive Committee, in attempting to implement Association policy against mandatory retirement at age sixty, explored and promoted several test cases based on individual exceptions or waivers to the specific FAA regulation,

THEREFORE BE IT RESOLVED that a legal opinion as to possible further steps that can be taken, including a suit against the Government.  Such information should include the form of such suit, the estimated cost and the probability of success, and 

BE IT FURTHER RESOLVED that opinions on this matter be obtained from the staff Legal Department and from Mr. Weiss and from Mr. Madole.

This action was taken simply as a prelude to active pursuit of a course to upset the age sixty ruling.  Negotiations are now under way between the Home Office legal staff, Mr. Weiss and Mr. Madole to determine the course of action deemed more appropriate.  It is my impression that the Executive Committee does not intend to settle for any more arm waving, a resolution of this arbitrary ruling is long overdue.
