4. Petitioner Gitt's record as an airman is exemplary; he has never received an unsatisfactory grade on a flight check. On February 14, 1968, Captain Gitt completed a regular six-month proficiency and instrument check satisfactorily, indicating that he possesses, in all respects, the functional capability required of a pilot-in-command. Captain Gitt successfully completed his transition from piston-powered to jet-powered aircraft on November 27, 1960, and has operated jet aircraft under nearly every conceivable airborne condition. He has served continuously as pilot-in-command of jet airplanes for Eastern Airlines since November 27, 1960.

5. The text of Section 121.383[C] from which exemption is sought is:

"No certificate holder may use the services of any person as a pilot on an airplane engaged in operations under this part if that person has reached his 60th birthday. No person may serve as a pilot on an airplane engaged in operations under this part if that person has reached his 60th birthday."
