OF THE 1959 RULE

15. In 1959, the Administrator relied upon several geriatric, actuarial, medical and operational studies in support of the rule. In responses to ALPA's request for the "data, studies and material used in developing the proposed Rules," Mr. Quesada cited some 41 reference sources, which he listed in Exhibit 1 annexed to his affidavit submitted to the United States District Court for the Southern District of New York [Case No. 60 Civ. 296].

16. There is good reason to question the validity and currency of several of those sources as a basis for the rule even as of 1959. Of these 41 sources, nearly 70% of them were, in 1959, ten years old or more, more than half of them were then 15 years old or more, and several of these sources were materials published prior to 1930.
