Brief of Captain Michael A. Gitt, Complainant,

Respondents, in their brief, while purporting to pinpoint "the question on the merits in this case" then continue on to mention irrelevant matters as conditions allegedly requisite as precedent thereto. The fact that complainant never served as supervisory pilot nor sought such prior to his compulsory retirement is immaterial unless there is some requirement that he do so, and none is offered by Respondent. Their bold allegation that "he lacks qualifications" for such position is misleading when considered in light of the testimony elicited at the hearing before Mr. George S.
