Affidavit of two of them: Capt J R. Pace late of Genl Sturgis's Staff, & Dr A.P. Hampton, a loyal citizen of this town.

Upon the examination, I desired the Sheriff to take possession of the mule, until a final decision of the matter. This he declined, but delivered it into my possession, & I will hold it subject to orders, unless it be forcibly taken from me, of which I have some apprehensions, unless I have been misinformed.

I am satisfied that the mule is legally mine, under all military orders, & by civil law & am willing to abide a thorough investigation.
