I cannot have a Military Commission, but can have a jury of Military officers. I am very lothe to sit in judgement alone on the case It is too grave a matter. I took the deposition of the deceased last Thursday There were no witnesses none present but the two men
Henderson confessed, the crime but pleads self defense & says Simmons was going to strike him this S denies Collateral testimony can be obtained to prove the deceased was a quiet pious man I have known him for a year as a preacher, peaceable and of good repute & more than ordinary talent for one of his race. Henderson is reputed as always under the influence of liquor & 4 years in the rebel Army
If Chaplain Lawrence or any officer of repute can come down to my aid I shall be glad which I most respectfully ask for. It is no use to refer the case to the civil court Please answer by Capt Bryan
