Genl., The undersigned late Captain in the U.S. Military. Vol Engineers would respectfully submit the following facts. On November 13th 1865 shortly after his muster out of U S Service, he purchased lot No Twenty (20) on Market Street Chattanooga on which was erected a two story brick building. That said property had been taken up as abandoned and was controlled by the F B R & A L at this place, as the property of one James M Ball.

Your Petitioner would show to you that after a careful investigation he was satisfied that Mr. Ball had not been in the South during the Rebellion, but on the contrary was in he City of New York and that the said property, though not abandoned was taken possession of by the U S Military Authorities and used as a Medical Purveyor's Office and Store Room, that after our Army moved off toward the Sea, Brvt Col N.B. Lucas then in charge of the Bureau at this place seized the said property as abandoned, and placed it upon the Rolls of the Beaureau. Knowing that such was the facts, you Petitioner purchased the property of said James M Ball on said November 13th 1865 but
