He said Boyd took the Amnesty Oath May 15, 1865, and made an application for the release of this property - which was released by Special Order No. 187, dated December 14th, 1866. and all the unpaid rent for 1866 - amounting to $300.00 was relinquished. As there is no record of this suit on file in this office I had no knowledge whatever that any such case was pending. when the application for the release of this property was made, and the first information I even received on the subject was when Col Henry spoke to me a few days since with reference to the payment of the costs.

As the property had been restored prior to the date of the Decree, the only question then settled was that of the costs - all others having been withdrawn by the Plaintiff.-

The question which Colonel Henry now wishes to have decided, is. will the Bureau pay the costs in this case, or, will he have them to pay.
