James Whitis (White) for the shooting of the former by the latter (reported last month)

The Deputy Sheriff to whom the warrant for the arrest of Whitis was given failed to serve it. Suit cannot be made against this Officer successfully for said failure for the reason that the warrant was not handed to him personally, but to his wife. 

Jacob Jarrett was advised by me to appear before the Grand Jury at it's earliest sitting on the 1st Monday of this month, and make his complaint against Whitis, and they would be compelled to find a true bill against him, and he came to Murfreesboro for that purpose, when, instead of making his complaint, he was so far intimidated, or persuaded by a certain Justice, so called Esq Jenkins, and others, neighbors to Whitis, (so I understand), not to prosecute, at any rate he did not prosecute, and I have not seen him since.

I am told to day by good authority that Whitis soon after the outrage was committed learning that I was taking an interest in the matter, and fearing the Military might be sent to arrest him, carried two revolvers for weeks, and swore that no "damned blue coat" should take him alive.
