were informed that a bond for $8000.00 must first be executed with two or more good securities before they would be permitted to exercise the functions of their office. The consequence was the constables elect could not get loyal bondsmen because they were intimidated by threats from the opposite party that they would be marked and get into trouble so they were compelled to abandon the matter altogether. The Magistrate however was duly commissioned & opened an office. The freedmen who presented their claims before the new court were heard, processes issued and placed in the hands of rebel officers who returned them before some other Magistrate and thus defeating the wish of the Plaintiff by not having the case before a Magistrate of their own choice. In this manner business was taken out of the hands of the loyal Magistrate and by rebel constables placed in the hands of rebel Magistrates and thereby compelling the loyal Magistrate to tender his resignation

On the 11th of April 1863 Frank Miller (a confederate soldier of Genl. Wheeler's Command) Killed in Lebanon Jo Miller Col'd barber. The matter was brought before the Grand jury this week & notwithstanding the evidence was pointed positive and clear. The Grand jury refused to find a true bill against Frank Miller. The latter learning the case was before the Grand Jury started for parts unknown, and by a friend offered to compromise
