Special Release

WHEREAS, Ilene Segaloce ("Artist") is a visual artist;

WHEREAS, the Artist has asked ("interviewee") to consent to be interviewed for purposes of a videotape presentation by the Artist and the Interviewee has consented to allow the Artist to videotape and to use his or her image, voice and remarks;

WHEREAS, the Artist intends to use the videotape of the Interviewee together with videotapes of other interviewees as part of an art project on videotape called "What is Business?" ("Art Project");

WHEREAS, the Artist presently intends to exhibit the Art Project at not-for-profit organizations generally and elsewhere and possible thereafter to sell the Art Project;

NOW, THEREFORE, the Interviewee executes the following Special Release for the benefit of the Artist:

1. The Interviewee on his or her behalf and on behalf of his [or her] heirs, successors an assigns, and any person or entity he or she controls, is controlled by, or is under common control with the Interviewee, does hereby, for good and valuable consideration, the receipt of which is hereby acknowledged, release and forever discharge the Artist (and each past, present, or future partner of the Artist), his respective agents, employees, representatives, predecessors, successors, assigns, heirs, executors, and administrators from any and all claims, causes of action and liabilities whatsoever which the Interviewee has or may have against the Artist based on or arising from (1) the Artist's interview of the Interviewee, (2) the videotaping of the interview, (3) the exhibition of the Art Project, and (4) any other aspect of the production, installation, exhibition, documentation, or sale of the Art Project, including, but not limited to, any claim by the Interviewee based on right of privacy, right of publicity and exploitation, libel, slander, mental or emotional distress, right of participation in the process, if any, generated by the Art Project, and any other claim, cause of action or liability whether based in tort, contract, property or equity.
