Conditions Governing Loan

1. Property lent to the Canadian Club Hispanic Art Tour III (CCHAT) for exhibition shall remain in its possession for the time specified in the Loan Agreement, but may be with-drawn from exhibition at any time by the director of the museum/gallery which houses the exhibit.

2. It will be the responsibility of the lender to proide [[provide]] traveling crates for his works. Transportation costs will be assumed by the Canadian Club Hispanic Art Tour.

3. Loans will be returned only to the owner or lender or his duly authorized agent. In signing this agreement the lender certifies that he is the legal owner or owner's authorized agent of the described property in question.

4. If the legal ownership of the described property shall change during the pendency of this loan, whether by reason of death, sale, insolvency, gift or otherwise, it is the responsibility of the new owner and the lender to notify CCHAT, giving full name and address in writing. The new owner may be requested to establish his legal right to receive the described property by proof satisfactory to CCHAT.

5. Under the terms of the agreement, CCHAT will exercise due care in respect to loans to the exhibit.

6. Objects lent to CCHAT at its request will be insured by CCHAT against all ordinary risks while in its possession and in transit, unless transported personally by the lender or his authorized agent. CCHAT will insure invited loans at the valuation requested by the lender in writing. When written notice of valuation is not given, CCHAT will insure invited loans at its own estimated valuation. Otherwise the lender may continue his own insurance for the period of the loan, although in this instance CCHAT will not accept responsibility of any errors in coverage.
