City & County of New York p?  William Oliver Stone of the said City being duly sworn says that on the 12th day of April inst he was present at the Exhibition rooms of the National Academy of Design in Tenth street in said City from about 3 to half past 3 oclock PM. - That deponent on entering said rooms found there Mr Charles L. Elliot in a drunken intoxicated condition acting in a disorderly manner & making use of abusive and improper language in the presence of ladies and others visitors at said rooms, that deponent expostulated with said Elliott as to such conduct & endeavored to induce him to leave the rooms, which said Elliott refused to do. - deponent then retired from said rooms to find Mr Stearns or some other member of the council of said institution deponent found Mr Stearns who said he would go immediately for a policeman, at which moment deponent was informed that Mr Elliot was cutting a picture from its frame   
Deponent immediately returned to said rooms & there saw the said Elliott in the act of cutting from its frame with a knife a picture painted by him and numbered in the catalogue of said Exhibition          a picture the work and production of said Elliott, that deponent & Mr Hayes then conducted said Elliott from said
