28 Provided, that orphans coming under
29 the provisions of this Act shall be au-
30 thorized to select said employers, when
31 they have arrived at the age of puberty,
32 unless they shall have been previously
33 apprenticed; Provided, that an inden-
34 ture of apprentice and indented servant,
35 made before a Justice of Peace and 
36 two disinterested witnesses, and the
37 original deposited with and recorded by
38 the Recorder of Mortgages for the
39 Parish, in a book provided for that pur-
40 pose, shall be valid and binding on the
41 parties. And, when made by the Clerk,
42 shall be, also, deposited with the Re-
43 corder of Mortgages; and all expenses
44 for passing said acts of indenture shall be
45 paid by the employer.
Sec. 2. Be it further enacted, &c., That
2 persons who have attained the age of
3 majority, whether in this State or any
4 other State of the United States, or in a
5 foreign country, may bind themselves to
6 services to be performed in this State, for
7 the term of five years, on such terms as
8 they may stipulate, to work on farms,
9 plantations, or in manufacturing estab-
10 lishments, which contract shall be valid
11 and binding on the parties to the same.
Sec. 3. Be it further enacted, &c., That 
2 in all cases where the age of the minor
3 cannot be ascertained by record testi-
4 mony, the Clerk of the District Court,
5 Mayor and President of the Police Jury,
6 or Justices of the Peace, aforesaid, shall
7 fix the age according to the best evidence
8 before them.
