The Capt. denies authority of Sheriff to arrest him, and the latter aided by a Co. of Militia made the arrest after night. Encloses report of Lt Bamberger, who reports that Capt Peck imprisoned Mr Brown for refusing to pay the tax on his negro employees, as authorized by War Dept and on Mr B's repeatedly entering the Capt's office intoxicated was put out by the guard under orders of Capt Peck. Also encloses copy of request by Gen'l Osterhaus for the release, and Gov. Humphreys letter to Lt. Col. Donaldson refusing to release Capt. Peck
